Terms of Service

These Terms of Service (“Terms”) are between JN Technology Limited (“Encompass One”, “we”, “us”) and the organisation or person using the service (“you”). By creating an account or using Encompass One you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.

Encompass One provides software for safety compliance (such as COSHH, RAMS and risk assessments) and HR management (such as employees, leave, sickness, training, timesheets and document acknowledgements). We may improve, change or discontinue features over time.

You must provide accurate account information, keep your credentials secure and are responsible for activity under your account. The service is for business use by people aged 18 or over.

You agree not to misuse the service, including not to:

• break the law or infringe others’ rights;
• upload malicious code or attempt to gain unauthorised access;
• disrupt or overload the service; or
• resell or provide the service to third parties except as permitted.

You retain ownership of the data you upload (“Customer Data”). You are the data controller for personal data about your people and are responsible for having a lawful basis to process it (including any additional condition for special-category data such as sickness records), and for informing your staff as required. We process Customer Data as your processor under our Privacy Policy and Data Processing Agreement.

Paid plans, fees, billing cycles and any free trial will be as described at sign-up or in an order. Fees are payable in advance and are non-refundable except where required by law. We may change pricing on reasonable notice.

We and our licensors own the service and all related intellectual property. We grant you a non-exclusive, non-transferable right to use the service during your subscription. You may not copy, modify or reverse engineer the service except as allowed by law.

Encompass One is decision-support software. Assessments, documents and outputs are aids, not a substitute for professional judgement. A competent person must review final assessments before they are issued or relied upon. You are responsible for your compliance with health, safety and employment law.

The service is provided “as is” to the extent permitted by law. We do not exclude liability that cannot lawfully be excluded (such as for death or personal injury caused by negligence, or fraud). Subject to that, our total liability arising out of the Terms is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss.

You may stop using the service and close your workspace at any time. We may suspend or terminate access if you breach these Terms or to protect the service. On termination you may export your data for 30 days, after which we may delete or anonymise it.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

We may update these Terms; we will post the new version here and update the date above. Continued use means acceptance.
